Terms of Service

1. Agreement to Terms

By accessing or using Uptraq (“the Service”), available at uptraq.io, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Uptraq is an uptime monitoring service. It checks the availability and response time of URLs you configure, sends downtime and recovery alerts, generates public status pages, and provides AI-powered incident analysis on paid plans.

3. Eligibility

You must be at least 18 years old and capable of forming a legally binding contract. If using the Service on behalf of a company, you represent that you have authority to bind that entity to these Terms.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@uptraq.io of any unauthorized access.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Monitor URLs you do not own or have permission to monitor
• Attempt to probe, scan, or attack systems via the Service
• Interfere with or disrupt the integrity or performance of the Service
• Reverse-engineer, decompile, or disassemble any part of the Service
• Resell or sublicense access to the Service without prior written consent

6. Subscription and Payment

Paid plans are billed monthly through Stripe. By subscribing, you authorize Stripe to charge your payment method on a recurring basis. All prices are in USD. You may cancel at any time; cancellation takes effect at the end of the current billing period with no partial refunds for unused time.

7. Refunds

We offer refunds within 7 days of initial purchase if the Service did not perform as described. To request a refund, email support@uptraq.io. Refunds are not available for partial billing periods or plan downgrades.

8. Service Availability

We aim for high availability but do not guarantee uninterrupted service. Uptraq is provided “as is” without warranties of any kind. We are not liable for missed alerts, false positives, or decisions made based on monitoring data.

9. Intellectual Property

The Service and all its contents are owned by Uptraq and protected by applicable intellectual property laws. Your data (monitors, incidents) remains yours.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE THREE MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

12. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time from the dashboard.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated by email at least 14 days before taking effect. Continued use constitutes acceptance.

14. Governing Law

These Terms are governed by applicable law. Disputes shall be resolved through binding arbitration or, where not enforceable, in courts of competent jurisdiction.
